Nursing floor: new request for review suspends judgment at the STF

The trial of the nursing salary floor at the Federal Supreme Court (STF) was again suspended this Friday (16), after Minister Dias Toffoli’s request for a view in the virtual plenary. The process had been released on June 9th by Minister Gilmar Mendes, who had asked for more time to analyze the matter on May 24th.

Before this Friday, the topic entered a virtual plenary session on May 19. With the new visa application, Toffoli has up to 90 days to return the process. The action evaluates the constitutionality of the category floor.

The proposal has caused concern in the public and private sectors. The lawyer specialized in Health Law Rebecca Paranaguá, a partner at Bento Muniz Advocacia, comments on the great impact of the increase and how the government could collaborate to reduce the shock to the budget.

“The impact is very big, especially for private hospitals that will not have a source of funding like public hospitals. So, ideally, there would be a measure to reduce this impact, such as payroll tax relief, which was a much-discussed issue, or finally other issues that could help reduce this financial impact, which will be very big for the sector” , he explained, reinforcing the lack of resources of private hospitals to pay for the readjustment.

A transfer is planned for the public sector to collaborate in the cost of the new salary floor, however municipal managers point out that the value is insufficient. The mayor of Santa Maria da Boa Vista (PE), George Duarte, explains that with the increase proposed by the government, the municipality needs R$ 320 thousand per month to pay for the floor, but the transfer that is made is only R$ 38 thousand, which generates a deficit of almost R$ 2 million in the year.

“We are not against any increase in any category, as long as the source of the revenue is mentioned and that it is passed on to the municipalities. Then we will be able to give this increase with peace of mind. If not, it is impossible for us to be able to pay the floor”, he adds.

According to Law 14,434/2022, which established the national nursing floor, nurses must receive at least BRL 4,750; nursing technicians, BRL 3,325 and nursing assistants and midwives at least BRL 2,375. According to a survey by the National Confederation of Municipalities (CNM), this revision of the minimum wage for the category will generate an increase of R$ 10.5 billion in municipal expenses.
