Mining: collection of fee charged for research authorization grows by R$ 19 million compared to 2023

The National Mining Agency (ANM) recorded an increase of R$19 million in revenue from the Annual Fee per Hectare (TAH) – the amount charged for mineral research authorization – compared to 2023. Data from the agency reveal that revenue rose from R$86 million to R$105 million until July 2024. Mining specialist lawyer Alexandre Sion explains that TAH are due for each year that the Research Permits are valid.

“As the name suggests, it is an annual fee that will be proportional to the number of hectares of the polygon covered by the research title. Currently, the TAH is regulated by Resolution No. 120/2022 from ANM c/c Resolution No. 150/2024. The annual value per hectare corresponds to R$ 4.53 in the first validity of the Research Permit and R$ 6.78 during the extension periods”, it informs.

According to ANM, the implementation of the National Collection, Revenue and Billing System (SINARC) – developed by ANM for the management of TAH and Financial Compensation for the Exploration of Mineral Resources (CFEM) revenues – was one of the reasons that led to the good performance of the sector.

However, for lawyer Valmor Bremm, a specialist in mining law, the positive result is not related to the new system, but to the increase in the amount charged by ANM. In addition, Bremm highlights another point, which he considers important.

“The National Mining Agency had a very large stock of idle areas and put all the areas up for auction. Most of these areas are research areas and are being granted, on average, three years for research, which means there is a boost and an increase in mineral research in Brazil. Mining in Brazil is now back on the rise, whether for strategic minerals or for the new energy change, such as gold ore, which is also on the rise. So, in other words, Brazil has a very strong focus on mineral research,” he says.

Valmor Bremm adds that, after payment, the resource will be used in the agency’s own management without the need for a specific destination.

New technologies

According to lawyer Alexandre Sion, the new system known as SINARC is part of the project to modernize the sector and consolidate the systems used by ANM through the “gov.br” identification.

“In the new system, only the miner himself – or people linked to him – are authorized to access the TAH to be paid in the respective fiscal year, and can choose to pay via simple boleto, PIX, credit card or collection boleto. The system’s payment facilities may have contributed to the increase in revenue”, he analyzes.

Even though the system is not the main factor for the increase in revenue, Richard Torsiano, an international specialist in land governance and administration and executive director of R.Torsiano Consultoria Agrária, Ambiental e Fundiária, believes that the insertion of new technologies contributes to improving process management.

“The agency, like other government sectors, is undergoing important innovations that, however simple they may seem, influence the management capacity of these agencies and public bodies, whether in ensuring the effectiveness of the application of public policy there, or even in collection processes, mainly through the implementation of technologies and systems that allow a direct relationship with the beneficiary at the end and make life easier for the beneficiary of the public policy”, he observes.

Richard says there are reasons to celebrate this result. “It is a significant increase, if we look at the history, especially the revenue that went from 59 million in 2015 to 105 million in 2024, and in the period from 2023 to 2024 alone, there was an increase of 19 million in this revenue,” he celebrates.

But he believes that simply charging a fee is not enough. “There must be appropriate instruments that guarantee transparency and effectiveness and that allow citizens to pay this fee more quickly, which allows the National Mining Agency to have better conditions to collect these fees,” he emphasizes.

Payments

Mining specialist lawyer Alexandre Sion clarifies that payment will always be made based on data provided by the ANM system, and that it is not possible to make “one-off” payments.

“Access to Sinarc is essential. Failure to pay the fine or untimely payment of the TAH will result in the miner being fined, in accordance with the ANM Resolution. Failure to pay or underpayment of the TAH, after the fine has been imposed, will result in the declaration of nullity ex officio of the research permit. In other words, it is an extremely important obligation, since, in a worst-case scenario, it could result in the loss of the mineral research title”, he highlights.

According to the ANM, the TAH must be paid by the submission of the final research report, on the scheduled dates. If the miner fails to make the payment, he/she will be subject to fines, in addition to running the risk of losing the permit that allows him/her to operate in the area. The agency emphasizes that the due date may vary according to the semester in which the permit came into effect.
